There are two ways a lawsuit can be dismissed: with or without prejudice. A lawsuit that is dismissed with prejudice means the plaintiff is not allowed to bring another lawsuit concerning the same issue in the future.

It showed that Arrowood and defendant's stipulated to the dismissal of action , without prejudice.

Question is why would they stipulated to the dismissal without prejudice if there is no settlement?
In other words, if there is no settlement then it would be better to stipulate with prejudice. Because it is no used in the future lawsuit.
