for those of you who don’t understand what intervening rights is here is my attempt at an explanation:

There are 2 types of intervening rights. Equitable and absolute. I’ll try to explain it as plainly as I can. So let’s say you own a special lawn mower. That lawn mower cuts grass in a special way.

Your neighbor steals your lawn mower and then sets up a business charging people to cut their grass. You find out he stole your lawn mower so you take him to court.

3 things can happen,

A- he’s found guilty with no intervening rights, he would have to pay you damages and etc.

B- he’s found guilty of stealing but the judge gives him equitable intervening rights, that means he will be able to re-coup any costs he incurred for his business he created but you will get paid any profits he made. Or

C-he could get absolute intervening rights which basically means he convinced the court he didn’t steal anything and doesn’t have to pay you a dime.
