Liquidated dameges are incorporated in most of the contracts we sign with owners(construction industry). The damages typically range in the thousands per calendar day the contractor is late, which is why all job schedules are designed around the critical path(path with the least float). When changes occur, a request for additional time will be requested based upon adding in the additional work requested by the owner. Liquidated damages will still apply per the original contract if the new end date is not met by the contractor.

So, I believe damages could be incorporated into any/most contracts. If contracts refuse to agree... someone else getsthe job who does.
