I though based on the way the filing read they couldn't own more than 9.99%. Filing are confusing anyway and probably designed to be.

Pursuant to the Certificate of Designations for the Series C Convertible Preferred stock, the issuer may not issue shares of Common Stock to the reporting person for conversion that would result in the reporting person owning more than 4.99% of all Common Stock outstanding immediately after giving effect to such issuance. The reporting person may increase the beneficial ownership limitation to 9.99%
