What I meant by suggesting the shares given to a broker as worthless are sent to the the transfer agent and then erased is the same as what you call "retired back to the treasury."

If such shares are sold again by anyone... the broker... the transfer agent... even the issuing corporation... such a sale would trigger a 100% capital gain because the basis for the shares would be zero.

It is unlikely anyone would want to be involved with such a proposition.
