IMO this has nothing to do with what the courts would "prefer" this is a case of infringement. It has nothing to do with something as objective as “fair” and everything to do with what’s JUST. There isn't a win win here, it is win or lose. If HCMC settles, then they win, and if they could go to trial then they could still win. If RJ wins their case then HCMC could lose, and if RJ loses then HCMC is right up there to win again. This has absolutely nothing to do with being "fair" and avoiding a "monopoly." Even if HCMC settles it doesn't mean that PM is entitled to their patents. Depending on the terms, they should negotiate a royalty. Either way you look at it, PM has the shorter end of the stick here. GLTA $HCMC
