If the appeal does not succeed in overturning Judge Casper's ruling, Worlds Inc. will likely request an en banc review, where all of the justices of the CAFC will vote. En banc reviews are seldom granted.

Upon losing at the CAFC, Worlds Inc. can petition for Cert from SCOTUS, which is a real long shot.

So your comment that the patents are worthless after the appeal to CAFC is not exactly (although likely) what may happen.

The patents are deemed valid until ALL appeals have been exhausted.
