It is not judge Allbrights "philosophy" that patents are assumed valid, as though he developed such a philosophy about it. That's just silly talk. I am the 1st one here on this blog, years ago, to have posted about the ridiculousness of questioning the validity of a patent. I explained that the very act of awarding a patent obviously comes with validity. The application goes thru a procecution process & if the patent is awarded, then it's a valid patent, period...until someone invalidates it. That's why, in the IPR's they gained nothing, because they never lost their inherent validity. To say you have a "philosophy" of a patent has validity, as opposed to someone else with an opposing "philosophy", is bogus. Patents are valid, PERIOD....until ruled otherwise. So of course vplm deserves an in-kind consideration. So the judge sets a good example here but it doesn't matter because vplm will find some way to steer clear of Alice & markman & discovery as it knows it better not come too close to that or their cover (the compelling story & the actual patent language) will start to unravel...
