James Lockhart was properly vetted and confirmed as Director of OFHEO. When FHFA was created, Lockhart assumed the position of FHFA Director without Senate confirmation. In most cases, I suppose, it would be alright. But as Director of FHFA, he yielded much greater (practically limitless) power. Shouldn't he have been re-confirmed? Is this something plaintiffs' attorneys should be considering?
