If they purchased the chips to build their mining rigs, or bought the rigs already assembled, as most miners do, then they would be in the clear. Consumers aren't the ones who pay a penalty for not checking for patent infringement. How could they know?
Unless they had their chips designed and manufactured for themselves, which is really expensive and unnecessary, they should be in the clear.
