In the Reid, et al case, Nutra Pharma claimed "set-offs" from the original settlement agreement. They had about a year to pay the Plaintiffs. During that time, they found out that those ex employees had stolen equipment from the lab. The Plaintiffs also launched several competitive products - that NPHC said was a "theft of trade secret". Nutra Pharma refused to pay the settlement, because the payment would provide a blanket release to the Plaintiffs and all of their cohorts.

The current lawsuit is for breach of the settlement agreement. The judge already limited their claims. If the offset is more than the Plaintiffs claims - NPHC will win. If not, they'll have to pay the difference if this ever sees a courtroom.

It would be better for everyone to sit down and calculate the difference and just settle this. Get one more thing off their plate.

IMHO - this will get settled quickly and move on to more important things.
