There is a nuance here that should not be overlooked. Without being able to read Casper's mind, we really have no way of KNOWING her motivation. All we can do is speculate. You felt that politics might be at play and, to your credit, stated that clearly and often prior to the 101 decision. If you repositioned your holdings based on that speculation, congratulations. Those who speculated differently were not as fortunate. But, at the end of the day, it comes down to speculation. Politics, laziness, poor reading of case law, desire to clear her docket after 10 years??? Nobody really knows. Sadly, we will probably never know her motivation (although if she gets a promotion your political speculation takes on added value). We all hope for a winning appeal but realistically we should all prepare for the worst case. JMHO
