There would only be a "Takings Lawsuit" if the price of FNMA ends up being lower as a direct result of the Warrants being exercised.
If FNMA is at a higher price after the Warrants are exercised (and by the time that ridiculous lawsuit would even be heard by a Court), then there would be no case and it would be dismissed with prejudice.
I hope that's not the theory Commons are riding on as it's not a pretty one.
