Per the red bolded item, was the NWS a valid action by the director?

For the NWS to be "a valid action" it would have to fulfill the FHFA's statutory responsibility as conservator to "preserve and conserve" the GSE's assets and return them to a "sound and solvent" financial footing.

The Justices had eight years worth of evidence as to whether or not the NWS had done this, so now it's up to them to decide.

I'll give you a hint: Justice Breyer made it rather clear he thought the NWS has done no such thing, but rather was an attempt by the Government to nationalize the companies.
