Either the lawsuit gets settled before the Merger or the Merger happens and then the lawsuit is settled. Now, I do not what kind of case Recommerce has to continue the lawsuit. So it is hard to anticipate the outcome. However, the fact the lawsuit was filed, and then the Merger announced could mean the lawsuit is a factor, but not the critical factor in the Merger not happening. I do believe funding plays a big part and the parties are trying to shape the structure of the company to enhance its fiscal strength. Thus making the company good collateral for a loan.
