So if this is the case, it would have happened BEFORE they acquired the CLHI shell from Synergy, correct?

This would raise questions. For example, if they had private owners ready to monetize their holdings in the form of public shares, would this have been disclosed to Synergy? And if they did, surely Ben would have looked at the O/S and said "hey, how do you think you are going to DO this?"
