So then we must figure out how they can both be true at the same time since we know definitively that they are. Right?

Right.

We know the shares have not been cancelled, despite rampant predictions that they would be cancelled. That argument and prediction has proven itself to be false.

Likewise, predictions about a payout has also, to date, proven itself to be false. The ticker has been suspended and the shares hold a current value of zero.

What will be a deciding factor is the determination of worthlessness, which has been addressed before.

If there is some authority which determines BioAmber Inc. shares to be worthless, (not just a zero value), and which said determination allows shareholders to meaningfully take a tax loss, then that would be the inarguable point at which a BioAmber Inc. shareholder must accept the injustice of a billion dollar enterprise supported by the tax dollars of two countries, Canada and The United States, being purchased by another billion dollar enterprise (KKR/LCY), for pennies on the dollar...OR...legally push forward and demand such an injustice be answered in a court of law.
