HMMM. Don't recall CEO Kenny ever mentioned this!

The last time Kenny said anything about it, he was still working on it, after the USPO had more or less rejected it.

When an old patent expires, one can not just turnaround and file a new patent for the same use, as the patent which expired. Else such things as generic drugs would never exist. The Brand name would keep on filing patents to replace the expired ones.

Either Kenny was totally stoopid about basic patent laws, or more likely he knew that filing a patent would still be good for a few PR pumps. Even if it was sure to be rejected. As in 3 yrs later SHs might not notice a status of "Abandoned".

Analogous to the IND filing. File it. Have it placed on permanent Hold. Come this Oct, the FDA will classify it as inactive. While Kenny pretends all is well in the garden, issuing his PR pumps.
