The SEC (judge) told the Division that they must address the gag order for the court to grant their Motion for a Ruling on the Pleadings and since they did not address it the Motion was denied. The Division does not need to address the gag order in a Motion for Summary Disposition but ERHC can argue that they could not file due to the gag order in a hearing to discuss the Motion.
