There may well be a connection to one of the oldest tricks in the book... IF the Debtor defaults when he clearly has the means to repay the Loan and the whole deal is contrived, then it's very likely to be ILLEGAL...

Did Suburban receive restricted stock and applied to the Court to have Restrictive Legends removed, as result of a Loan default?...
