Theft by deception sounds more like opening an account in a fictitious name and writing checks.

Yup, they gave him a felony. He wasn't some broke down on his luck guy who wrote some checks for groceries that ended up bouncing. He was clearly doing something with very shady intentions probably in a name other than his own. He was likely straight up grifting.

I knew a guy who broke into his neighbor's house and stole blank checks from their checkbook. He ended up writing a couple thousand dollars worth of checks over a several month period. He didn't get a felony.
