yes - although it was previously attempted by another company and Finra gave them the run around and it ended up in the hands of the SEC. The other company jumped into another shell instead of this one. (ALID).
The status of the case does not appear to be settled. if Culter was smart I guess he could see the action here and decide the shell might be worth keeping for himself. or make some deal with George not to contest.
