From what I have seen so far, Bass will have quite the task to show
why he called V & IV ponzi scheme. obviously, we have only seen one
side but the courts did reject Bass's arguments with distain so far.
If Bass can not make a coherent case to why what he did was not just
a malicious attack because he could - he will be liable for most or
all of the value lost at the time. the other side is the damage to
the value of the business by systemically destroying the ability to
conduct business. even under what UDF paid the SEC $8M of fines, I
do not see much relevance to the claims made by Bass.
