"The motion to dismiss will be denied. These are two highly respected law teams arguing on points of law, and on points of science. The judge can rule on law, but he will not rule on science without a thorough test of expert evidence in a public court. This stalling tactic is nothing more that SOP.
Remember that Cozen O'Conner is defending HCMC on a contingency basis. This means that PM's procedural posturing is only inflating their legal costs. HCMC are currently protected from that, and their costs will only be settled out of the damages proceeds.
Our best chance for a settlement is if HCMC can achieve an injunction against PM, when the case proceeds to trial. At that time PM will have to decide between settlement and the risk of losing long term, even lifetime revenue, from their consumers, who will have no choice but to switch to another brand.
The game is afoot. Strap in for the rollercoaster ride we have all signed up for."
