There are 2 kinds of short selling by the mm. The first is just selling short shares that already exist but some one else owns. Let's say you have bought through your broker a million shares of ABC co. great right! But hold on! If you do not call and ask explicitly for your shares to be printed in your name on stock certificates(a fee applies) then that broker or mm can loan your shares out to some one else and fill a order of a guy you dont know with your shares!


The second type of shorting is completely ILLEGAL, but mm do it anyway.. It is naked short selling. Which is selling people shares that dont even exist, let out on "loan" to some one else against your knowledge!

Both are practices that need to stop and I hope the new Congress will bring this issue to the house of representatives floor and force change of the trading rules! If mm and brokers where not allowed to short, then all markets prices would reflect true value based upon supply and demand!
