JOINT MOTION TO STAY PROCEEDINGS

Plaintiff Netlist, Inc. (“Netlist”) and Defendants SK hynix Inc. and SK hynix America Inc. (“SK hynix”), through their respective counsel, hereby jointly request that the Court enter an order staying all further proceedings in this consolidated matter, and all deadlines set forth in the Joint Submission of Proposed Scheduling Order (Dkt. No. 88), for thirty (30) days. Pursuant to an agreement between Netlist and SK hynix, the parties seek this 30-day stay to permit them to finalize and perform certain aspects of a settlement agreement recently reached among and between the parties. This stay is not sought for the purposes of delay, but rather to allow the parties to avoid incurring unnecessary litigation costs, while preserving the resources of the Court, until the parties are in a position to dismiss this action.
