Talking to you is like trying to hit a moving target. The thread you initially responded to , which I assume you read, another poster stated we win at trial and they pay the legal fees its all good. I commented to that post that each party pays their own legal fees etc. Its obvious that the attorney will get paid if WDDD wins and as you say it would be included in the settlement. You saying it could be a component of a settlement infers that the legal fees would be above and beyond the settlement figure or paid by ATVI. Its also obvious that any money accepted in a settlement comes from ATVI.

You then chimed in might not be part of a trial win but could be a settlement component. Maybe you meant one thing but your post conveyed something else. The context of the discussion was that the winner at trial gets their legal fees paid by the losing party, which is sometimes misrepresented here.

Now you try to weasel out of your statement and say since counsel is on contingency they are actually being paid by ATVI in a settlement. In your prior post, you also used the words IN ADDITION to legal fees, which conveys an amount above and beyond an agreed upon settlement amount not an amount included in a settlement. You say I am putting words in your mouth. Not so. Perhaps choose your words more carefully.

As I previously stated, it's rather obvious that counsel on contingency takes the agreed upon percentage off the top of any settlement. There is a clear distinction between that and a defendant actually paying legal fees which was the basis of the conversation to begin with.
