What do you mean by that?

If the 11th Circuit overturns the ruling then it will be punted back to the state supreme court for retrial. Do you see something different? USRM still needs to establish treatment efficacy for SVF. They need to point out that the procedures they perform (tissue harvesting and reimplantation) using SVF technique should be within the same category as "other" autologous SSP tissue transplant procedures which do not come under FDA oversight.

I would expect the 11th Circuit would want expert testimony from both sides. This would require retrial $$$. I do agree that a longer wait time might be an indicator for RR. We will see.
