One last consideration. The case was handled in the ED/TX which is widely regarded as the most patent friendly or desirable location to file patent cases. This is also a factor in the decision to award legal fees.

I do agree that it is a possibility to be awarded legal fees and never stated that it wasn't possible However, it is rare when it happens and not part of the routine trial or settlement process as some have suggested.
