Wishful thinking. Why would a company negotiate a settlement to include a factor that wouldn't be included in a trial win? A settlement is 1 figure or amount and will typically be significantly LESS than a trial win. A settlement will account for the infringement and at a discount for the convenience of a settlement. The company can cut and dice what they receive any way they want - after counsel takes the agreed upon contingency fee off the top.
