"One possible scenario is that ATVI could go to trial and lose and the Judge could infer that treble damages are being considered and then ATVI settles the case, thereby avoiding the possibility of treble damages.. That way it's clean and no appeals to drag on etc."
Not possible re: "go to trial & lose"( the judge can not at that point infer anything as Actavision had up until the jury goes into deliberate to settle & Actavision knos this)....THEN IT'S OVER with exception of an appeal
