The point of being incorporated is that the sins of the company are not necessarily, the sins of the board(or at least they have some legal separation)
As far as OTCM is concerned the "company" earned a CE label and that has not changed in their eye. The company did something, said something or failed to do or say something.
Making public plans for a RM and then not doing it is a bad start. Did someone sell some shares on that PR?
