I look at the Court Dockets and saw a Summary Judgement for a Motion to Compel. WHAT? Did the Movant filed an adversary proceedings against LBHI? Motion to compel are being use in discovery before trial. Summary Judgement are being use before trial if there is no triable issue. We are in Chapter 11 Reorganization and not in an adversary proceedings. In Chapter 11 Reorganization, they can file a petition to the Court for LBHI to issue the Certification, not Motion to Compel.
