We need to take a couple steps back and realize there are a few options we need to keep in mind:

The appellate court could send the case back down to the lower court, as we've mentioned.

They could give US Stem Cell a positive ruling without sending the case back down. This would be the best case scenario for US Stem Cell.

They could do nothing and let the lower court's decision in favor of the FDA stand. This would be the worst case scenario for US Stem Cell.

The pps could fall significantly before any of the above options occurs, even a positive one.

Keep in mind that I'm not a lawyer and don't play one on TV so all I'm doing is throwing darts with my left hand (I'm right handed) while blindfolded with my back toward the target. In other words, I'm simply speculating wildly.
