information that is not publicly available, then the person makes a trade based on the information Pedro told them, that is exactly the definition of "insider trading". Martha Stewart and many others have done just that and gone to jail for it.

Nobody should talk to Pedro-the-Clown, they could get into a lot of trouble for doing so if they trade on the information he gives them. That is what "conference calls" are for.
