If CA Stem Cell wins their case, I expect the next step would be for state and local legislation/board of commerce and medical boards to determine efficacy guidelines. The ruling would set a legal precedent that other states could follow. I think it will open the door to states adopting stem cell legislation that relies on medical board guidance as with all tissue transplants procedures not the effing FDA.

I am not sure what would happen with USRM's case if there was a favorable ruling in CA. It is important to note that when the 11th Circuit Court of Appeals RR's a case the district court is expected to start fresh at square one. So this may end up being an exercise of legal procedure and discourse. My gut feeling is that the Florida district judge would go along with the precedent set in CA but that may not happen.

District courts reach totally different conclusions and decisions ALL THE TIME, especially when judges and egos are involved.

That is why appellate courts exist and really SCOTUS, thee Supreme Court of the USA.

For sake of argument - judge Ungaro is just a hard headed witch and can care less about some CA "liberal judge" (her thoughts, not mine) - and she sticks to her guns, holds a bench trial and hands it to the FDA.

DONE as far as USRM is concerned.

ONLY recourse then for USRM is appeal to SCOTUS and use the CA ruling as ammo for a Supreme Court appeal.

The mega elephant lurking here - the 100,000 ton special, is USRM IS CASH BROKE and it literally gets worse by the day, by the minute !

USRM does not have the cash or much left to keep litigating for a year, or years to come ?

They're busted broke and being sued now by creditors for very, very large amounts of money in a game of "beat the BK clock" - as a "win" by a creditor and they could be petitioned to file BK which wipes the common shares to $zero in the blink of an eye.

It's dicey - this COVID crap is making courts move like watching dormant grass grow in a long winter. It's beyond pathetic.

File ONE MOTION in a civil case - wait 3 months for a ruling back. ALL resources have shifted to criminal cases due to "right to a speedy trial" when some schlub is sitting in a lock-up at the county jail or even state prison "awaiting his/her day in court".

CIVIL MATTERS = lowest man on the totem pole now. That's the bad reality.

SPEEDY JUSTICE = a joke to put it mildly. USRM is in a cash survival game at this point - and a real dicey one IMO.
