The way I see it $HCMC holds all the cards. They can either choose to have PM continue selling the product which in turn brings way more money to the lawsuit the longer PM keeps using the stolen patent infringement device, or they could decide to issue a cease and desist on the product thus crippling PM since so much of their business has shifted toward the vaping. PM needs to settle or buyout/takeover the company quickly for their best interests. If they try to drag this case out then that will end up costing them so much money by either of the two choices $HCMC might make as listed above.
