Looks like the DOJ has not decided if they want to press criminal charges against Neilsen. So maybe the speculation that there was some kind of connection with Dr Schena might be true. Looks like they will pick Neilsen's case up in April. The plot thickens


Since this court granted Mr. Nielsen’s Administrative Motion to Enlarge Time to File Answer to Complaint and Re-set Case Management Conference (Dk. No. 12) and Stipulation And Order Enlarging Time To File Answer To Complaint And Re-Set Case Management Conference (Dk. No. 16), I Have communicated with the Department of Justice (“DOJ”) attorneys in Northern District of California case United States v. Mark Schena, CAND Case No. 5:20-CR-00425 EJD (formerly 5:20-MJ-70721-MAG). The DOJ attorneys have not affirmatively ruled either way whether they will file or seek criminal charges against Mr. Nielsen.

4.On February 2, 2021, I had telephone call with Securities and Exchange Commission (“SEC”) attorney John Han. The SEC takes no position as to the possibility of criminal charges against Mr. Nielsen. However, Mr. Han and I agreed that due to the uncertainty of whether criminal charges might still be initiated against Mr. Nielsen that the parties agree to atwo-month stay to allow time to determine Mr. Nielsen’s potential criminal exposure.
