i guess my point is that..

my base case doesn't have scotus ruling on the math behind any of that.

just basically re-confirming the en banc's interpretation of HERA and that plaintiffs have a valid claim; and then the case gets remanded back to lower court to review...

so i'm not expecting the massive judgment you seem to be suggesting is imminent.
