If a public company qualifies, pays the fees and yet its actual business is drug smuggling, trafficking children for prostitution and making midget lesbian kiddie porn NASDAQ would still not be responsible in any manner whatsoever.

NASDAQ does not vet a businesses viability, integrity or honesty. An issuer never meets a NASDAQ agent or vetting committee.
