this is not something they have to decide, so largely speaking i expect they don't decide on this.
that said i think their ruling reversing the motion to dismiss and guidance about what a conservator can and cannot do under hera, i think that makes it clear to anyone who is honest with what has happened and transpired that the net worth sweep is illegal -- and that the government now, according to the prevailing scotus perspective which is how all lower courts nation wide need to follow precident, is fighting a losing battle..
and so they aren't stealing money to pay lawyers to fight so that they can steal more money.. the cash payments are being retained by the companies
so if you're the government, in 6 months you have a choice.
do you want to pay out of your own pocket to fight a losing battle with contingent $100B+ cash liabilities?
or do you want to settle this and profit and close the trade and fix the companies and follow the letter agreement.
you can fight it for a while if you want to, but why bother.
especially when all the people who would want to fight it would with this scotus ruling basically be incriminated.
then who is going to certify a trial record where ugoletti commits perjury? lol.
