Holden - unless Mnuchin confused his words, he directly spoke to a consent order.

“There could be a scenario where at some point between basically the zero capital they have and the full capital requirement, there would be a consent order and they would be release subject to a consent order,” Mnuchin said. “There’s got to be significant capital for them, in my opinion, to be released.”



I’m using the terms fine - admittedly I may have interchanged by accident here or there - but Mnuchin is speaking to a consent order, which I believe at minimum he has de facto oversight on a release via the PSPA.

Yes, a consent decree is a court defined agreement, and IMO will be needed also before Jan 20th due to the legal question before SCOTUS on acts by a director who is not under the control of a president. You are missing that legal angle ...
