Ripple should do what is best to obtain clarification from SEC, because that is the key move needed for XRP. the likely 'best move' is to show SEC politely and professionally their lawsuit has incorrect merit, and, in the "interest of expediency" work out a small fine agreement (pay blood money) with SEC. This way the SEC gets their handout, and in the process gives Ripple / XRP the much needed regulatory clarity. win/win

"going after them all" as you mention would yield no results and risks dragging the situation on for years.
