If Mark was trading his account and benefited from insider info he is in big trouble. The charges related to insurance fraud for testing that was ordered by a Doctor during appointments with their patients are going to be difficult to prosecute due to HIPAA laws. Basically any information between a Doctor and his patient is protected by law. As for the so called "kickbacks" which could also be called incentive bonuses or secondary compensation, U know that it happens everywhere, in every line of work.
