That's my thought Stark. Far more likely that that discovery supoenas have been delivered. I mean, who wasn't expecting that when the deadline for discovery is fast approaching.
Re: Linden, I haven't dug into the specifics of that litigation so don't know if we have asserted the same claims or others, but no matter which, we now know that the terms of action going forward will primarily be set by the claim construction that we proposed.
Does that mean they jump to settle, probably not - at least until the 101 is decided. After that, they will have few options but to either settle or press forward with a trial given that we've already won the PTAB and appeals decisions. Which is probably the same logic of the people who bought in today.
I'm looking forward to Monday as, I think (hope) that as more people learn of this Markman outcome, the more will decide that now is the time to start building a position. We shall see.
