responsibility for long-tail asset recovery for the benefit of the
Shareholder as the Administration draws to a close.
Managing the affairs of the company continues to sit with the
Administrators until such time as LBIE exits administration; and
is returned fully as a solvent entity to the control of directors to
be managed as a going concern for the benefit of the Shareholder."
Thanks for posting this again Cotton... The Judgement has made it plain and clear that the distribution of #29M (and also an additional amount, as we noticed in the full judgement previously posted by Cotton) are 'dividend' payments to the ECAPS by LBIE Administrator...Also, as the Judgement clearly states above, LBIE is to exit as a 'going concern' and control will be returned to the Directors, who will then run it to keep it as a solvent company and will decide as to when to institute further dividend distributions... Hopefully that means the ECAPS will remain true to their originally issued security class structure.
