As my legal friends have said, everyone starts out Not Guilty. I'm just wondering what Pickles is saying. He comes from the other side, and I'm sure he has been in many discussions with the DOJ. Now that the Grand Jury has spoken, I'm wondering whats the discussions happening now about how to move forward.
My thought is Dr Schena will go the whole route Not Guilty as anything less will brand him as a felon for the rest of his life. But as I said, Pickles is a seasoned lawyer that knows what's coming down. If he feels there's nothing he can do (or has a very weak defense), I'm sure he has advised his client. It's up to Dr Schena to make the call. Some go right to the morning of trial and then take the deal. The trial will be expensive for going in with a bad chance of winning.
I would think the delta would be 5 years added or so if he loses compared to taking a deal. But I don't know, I'm guessing. The DOJ seemed eager to go to trial, and have turned over all of the discover evidence for preparation.
I guess next week will peel the onion back one more layer.
