Legislative Ramifications of Biden Presidency with Republican Senate on Hemp-CBD and MJ

Let’s talk about the 2 different forms of political support for any piece of legislation

Party Support — Repubs/Dems

Congressional Chamber Support — Senate/House


Hemp-CBD Legalization (Beverages/Supplements) Party Support

Supported very strongly by Repubs ***

Supported very strongly by Dems ***

*** Many states passed Hemp-CBD Legalization unanimously, something we’ve never seen with MJ Legalization, which has struggled to garner enough support to pass in many states due to Republican opposition

NJ is a great example of this, where even after they elected a Democratic Governor in 2017 who ran on a prominent platform of Recreational MJ Legalization (Governor Phil Murphy), despite his and the NJ Dem Party’s best efforts, NJ Repubs remained strongly opposed to voting for Rec MJ — even after trying for 3 consecutive years to pass Rec MJ thru the legislature, it simply wasn’t going to happen, which is why NJ was forced to put Rec MJ Legalization on the ballot this year


Hemp-CBD Legalization (Beverages/Supplements) Congressional Chamber Support

Supported very strongly by Senate (Mitch and Chuck in particular and they are the main decision makers)

Supported strongly by House


MJ Legalization Party Support

Not supported by Repubs

Supported strongly by Dems


MJ Legalization Congressional Chamber Support

Opposed strongly by Senate (Mitch in particular, who has never allowed a MJ bill to be voted on in the Senate)

Supported strongly by House


In order to pass any MJ Bills in Congress, both the House and the Senate need to be on board

With a Republican-controlled Senate, particularly with Mitch at the helm, MJ legislation simply cannot make it thru

The biggest upset in the election was the fact that the Repubs were able to hold onto control of the Senate

Dems were favored to take control, and if that had occurred, with Dems and Chuck taking over control of the Senate, then there would have been a possibility of some type of compromise in the impasse on MJ between Biden and the Dems

Alas, Repubs successfully fought off the Dems and remain in control of the Senate

I wish Mitch wasn’t so anti-MJ, because I’d love to see it legalized in any form, but he’s 70 years old and he is who he is, both ideologically and as a master political strategist for the Republican Party in the Senate

He simply doesn’t see it in his own interest or his party’s interest to allow any form of MJ Legalization to happen on his watch (with the possible exception of the full legalization of cannabis banking — MJ and Hemp/CBD — via The SAFE Banking Act, especially if it will be utilized as a legislative vehicle for CBD Legalization)

Now there is one caveat

Repubs and Mitch control the Senate now, but there is an outside chance of Dems gaining control by way of the Georgia Senate runoff elections that will be taking place in Jan 2021

For the Dems to take over the Senate, they would need to win both of the races in Georgia

I think that’s unlikely right now, and the betting markets agree, as they currently have the odds at 20%

Let’s keep an eye on any future polls and the betting markets to see if the probabilities change
