The following pattern shows how desperate AAPL is:
1) AAPL failed 2 IPR's at PTAB giving 8 to 0 wins to VPLM
2) AAPL failed in their attempt to "sanctions" against VPLM - PTAB
3) PTAB gave an opportunity to AAPL to point out any errors in their ruling. AAPL's response was unconvincing. PTAB denied.
4) At the recent Federal Court hearing on Sanctions, AAPL argued totally different issue viz. denying all non-overlapping claims from VPLM patents. Appeals Court denied.
5) Now AAPL is using "Declaratory Judgement" to transfer from WACO, raise other unrelated issues in NDCA.

Curious if you have seen the court documents from TWTR and AAPL. Some investors are nervous about any court hearing under Koh, not enough faith in Mr. Hudnell's ability to challenge and argue successfully.
