They filed for it so it's on the books. They could wait years to enact it. If they did it now and (not saying they would) lower the A/S they wipe out they're notes in the process. That Theyre are a lot more variable then just a WHAMMO RS...if that was the case then why not a crippling 10,000-1 LOL
